For recruitment agency payroll, once a candidate is hired, they become an employee of record at the client company.

Temp staffing agencies remain the employer of record for any recruits hired by a client company. This means the staffing agency is liable and responsible for compliance with all local, state, and federal labor laws including hiring and firing. Luckily, Gusto’s built-in compliance can handle most standard compliance issues, and our team of HR experts are always on hand to help with more complex compliance questions you may have.

Nope. For independent contractors, you’ll only be charged in the months you pay them. To avoid being charged each pay cycle for inactive W-2 employees, you’ll need to dismiss the employee and rehire them when they start a position at a new client company. Alternatively, you can “furlough” employees, which pauses their payroll while keeping their benefits active, but you’ll still be charged the monthly fee for any employees on furlough.
