The real estate industry operates differently than most other industries as earnings are often 100% commission-based. This means real estate agents and brokers don’t earn anything unless they make a sale. While commission structures vary, typically, a 6% commission is split four ways: 3% between the seller’s agent and broker, and 3% between the buyer’s agent and broker.

A real estate agent is someone who is licensed to help you buy or sell a home. The agent will earn a percentage commission on the sale, usually paid for by the seller. A real estate agent is not licensed to work independently, however, and must be employed by a real estate broker.
A real estate broker can also help you buy or sell a home, but they are licensed to operate independently as well as to employ agents on their team. Any agent working for a broker (whether a larger firm or a small, independent brokerage) will have to split part of their commission with the broker.

Currently all commission payments added for W-2 employees in Gusto are taxed using the “aggregate method” which treats them as regular wages and withholds tax based on an employee’s W-4. We do not apply the supplemental wage rate of 22%. However, as most real estate agents operate as statutory nonemployees (independent contractors), no taxes are withheld, and agents are responsible for paying quarterly taxes under the self-employed taxation rates.
Gusto real estate payroll does not currently support commission draws.
