Gusto HR Resources Support Center Beta Terms

These HR Resources Support Center Beta Terms (“HRSC Beta Terms”) are Additional Terms under the Gusto Employer Terms of Service (“Employer Terms”). Capitalized terms not defined herein have the meanings given in the Employer Terms. HR Resources Support Center Services means, collectively, the following features: (a) Employee Handbook, (b) Ask an HR Expert, (c) HR Document Generator, and (d) HR Law Updates, each as set forth below (collectively, the “HRSC Services”).

By accessing or using any feature within the HR Resources Support Center, Employer agrees to be bound by these HRSC Beta Terms. Where these HRSC Beta Terms conflict with the Employer Terms, these HRSC Beta Terms control with respect to the HRSC Services. For all other matters, the Employer Terms govern.

1. Eligibility and Beta Status. The HRSC Services are included in the Premium plan (as described at gusto.com/product/pricing) at no additional cost. If Employer downgrades from the Premium plan, access to the HRSC Services will terminate in accordance with Section 12 of the Employer Terms. All HRSC Services are Beta Features as defined in Section 13 of the Employer Terms. Gusto may modify, suspend, or discontinue any HRSC Service, in whole or in part, at any time and without prior notice. Gusto makes no commitment regarding the general availability of any HRSC Service beyond the beta period.

2. HRSC Services. The HRSC Services consist of the following features:

a. Employee Handbook: Maintains a personalized employee handbook with ongoing updates and state-aware coverage. This feature is governed by the Handbook Builder Terms of Service, which control over any conflict with these HRSC Beta Terms.

b. Ask an HR Expert: Permits Employer to submit HR questions for guidance. Gusto may triage inquiries using automated or AI-assisted systems before a Gusto HR professional responds. Employer agrees not to share Protected Health Information (as defined in 45 C.F.R. Part 160) with Gusto through this feature.

c. HR Document Generator: Generates HR documents (including performance improvement plans, termination documents, and accommodation materials) from information Employer supplies. Each generated document constitutes “Gusto Content” under the Employer Terms. Employer must review every generated document for accuracy and legal sufficiency before use. The indemnity and liability limitations in Sections 21 and 22 of the Employer Terms extend to errors in generated documents.

d. HR Law Updates: Delivers proactive notices of employment-law changes affecting Employer’s designated states and localities. All notices are informational only. Gusto does not warrant their completeness or timeliness.

3. No Professional Advice. The HRSC Services are informational in nature and do not constitute legal, tax, accounting, or other professional advice. No information, guidance, or document provided through the HRSC Services creates an attorney-client, fiduciary, or other professional relationship between Gusto and Employer. Employer remains solely responsible for its own compliance with all applicable federal, state, and local laws and regulations. Gusto is not responsible for any employment decisions Employer makes, or fails to make, in reliance on the HRSC Services. Employer should consult qualified legal or other professional advisors before acting on any information obtained through the HRSC Services.

4. General Provisions. These HRSC Beta Terms, together with the Employer Terms, constitute the entire agreement between Gusto and Employer regarding the HRSC Services and supersede all prior or contemporaneous communications on that subject. If any provision of these HRSC Beta Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. All notices under these HRSC Beta Terms shall be provided in accordance with Section 26 of the Employer Terms. All provisions of the Employer Terms not expressly modified by these HRSC Beta Terms, including without limitation those relating to warranties, indemnification, limitation of liability, intellectual property, and data processing, are incorporated by reference and apply in full to the HRSC Services.
