TheseCreator Tiered Discount for Gusto Solo Promotion Terms (“Promotion Terms”) together with the Gusto Terms for Promotional Offers & Discounts (“Discounts Terms”) and the Gusto Employer Terms of Service (collectively, the “Creator Promotion Agreement”) contain the terms and conditions that govern participation in the Promotion. Capitalized terms not defined in these Promotion Terms have the meanings ascribed to them in the Gusto Employer Terms of Service. In the event of a conflict between these Promotion Terms and the Discounts Terms, these Promotion Terms will govern.

By participating in this Promotion, you agree to be bound by this Creator Promotion Agreement.

1. Eligibility & "Qualified Solo Creator" Status

To be eligible for the Promotion, you must be a “Qualified Solo Creator.” A “Qualified Solo Creator” is strictly defined as an individual who meets all of the following criteria at the time of enrollment:

(a) Account Status: Maintains a new, active Gusto Solo account. The account must be the primary owner and not an administrator added to an existing organization.

(b) Social Verification: Possesses a public-facing social media presence on one or more Gusto-approved platform (currently Facebook, Instagram, TikTok, YouTube, LinkedIn, or X). Follower counts across qualifying platforms may be aggregated to meet tier thresholds. By participating in this Promotion, you represent and warrant that you are the sole authorized owner or operator of each social media account submitted for verification.

(c) Verification: Has a follower count and account ownership that has been verified by Gusto through it's designated verification process, which may include direct message, public post, or other account-ownership checks conducted via each claimed social media platform.

(d) New Customer: Has a federal EIN or SSN that has not previously been associated with an active, paid Gusto account. Gusto may, in its sole discretion, extend eligibility to former Gusto customers who do not currently maintain an active paid Gusto account.

(e) Verification Cooperation: Agrees to respond promptly to Gusto's verification requests, including communications sent via social media direct message, email, or phone. Failure to respond within seven (7) calendar days of Gusto's verification request may result in denial of the Promotion.

2. The Promotion

Qualified Solo Creators are eligible for a one hundred percent (100%) discount on their Gusto Solo subscription for a set number of consecutive months (the "Discount Period"). The discount covers the base subscription fee and the per-person fee for the account owner’s own payroll and any contractors, as listed at gusto.com/product/pricing (or any successor URL), currently totaling $49 per month base and $6 per person per month. The following add-on features, if activated on or before the Start Date, are also included in the Discount Period at no additional cost: (i) Time & Attendance Plus and (ii) Priority Support, each as described at gusto.com/product/pricing (or any successor URL). Such add-on features activated after the Start Date will be charged at standard rates. This discount does not apply to other per-person fees, international fees, other optional add-on services (e.g., 401(k) administration, health insurance), or any other fees outside the base subscription. The specific tier is determined by the Verified Follower Snapshot taken by Gusto at the time of review:

The Snapshot Rule: The applicable tier is fixed based on the aggregate follower count across all verified platforms at the moment of initial verification. Subsequent growth in followers during the Discount Period does not qualify the participant for an upgrade to a higher tier.

3. Activation, Triggers, and Billing

(a) The Trigger Event: Gusto applies the discount to the Qualified Solo Creator's account following successful verification (the "Start Date"). The Discount Period begins on the first billing cycle in which the creator is charged for the Gusto Solo subscription. If the Qualified Solo Creator does not process a paid payroll within ninety (90) days of the Start Date, eligibility for this Promotion expires automatically and Gusto will have no obligation to honor the Discount Period.

(b) Billing Lag & Credits: In the event that any billing cycle closes before the discount has been applied to the account, Gusto's sole obligation is to apply the discount beginning on the next billing cycle. No service credits, refunds, or retroactive adjustments will be issued for any charges incurred prior to the application of the discount.

(c) Expiration: The discount automatically expires at the end of the applicable Discount Period. Upon expiration, the account will renew at the then-current standard Gusto Solo monthly rate.

4. Product Restrictions

(a) Solo-Only Scope: This Promotion is exclusive to the Gusto Solo plan.

(b) Cancellation: Unused Discount Period months do not roll over, convert to credits, or have any cash value upon cancellation of your Gusto account.

5. Conduct, Fraud, and Brand Safety

(a) Authenticity & Organic Growth: Gusto reserves the right to audit follower counts and social media account ownership using third-party analytics tools or direct verification methods. Evidence of "bot" activity, purchased followers, misrepresentation of social media account ownership, or engagement farming may result in immediate disqualification and retroactive revocation of the discount.

(b) Brand Safety: Gusto reserves the right to deny or terminate the Promotion if the Qualified Solo Creator’s public content is deemed inconsistent with Gusto’s values, including but not limited to content promoting hate speech, illegal activities, discrimination, or harassment.

(c) Referral Conduct: While this Promotion may be paired with a referral program, participation in this Promotion does not constitute an employment or formal agency relationship with Gusto.

6. Modification and Termination

Gusto may modify, suspend, or terminate this Promotion (including modifying the follower thresholds or discount duration) at any time for any reason. Gusto reserves the final right of interpretation regarding "Qualified Solo Creator" status and "Verified Follower" counts.
