When your business has an employee, a physical location, or other operations in another state, you become subject to compliance requirements in that state. This can include registrations as well as ongoing filings, taxes, and renewals.
As part of Gusto payroll, compliance related to paying employees and paying employee related taxes is handled, but that’s not everything your business needs to do to be compliant. Your business may also need to register with the Secretary of state, file annual reports, have a registered agent, and other state and local requirements.
A registered agent is the designated contact who receives legal and official government mail on your business’s behalf. If you’re your own registered agent, your business address is public record. When Gusto is your registered agent, your filing address stays private, and your mail is monitored and routed to you through Gusto.
In most cases, yes. A remote employee generally creates a physical presence, or “nexus,” in that state, which typically means you need to register with the Secretary of State (foreign qualification) and set up new state tax accounts. Gusto Business Compliance can help you handle both.
