May 2021 Partner Promotion Terms

Accountants or accounting firms (each, a “Partner”) that (a) are enrolled in the Accountant Program (the “Accountant Program”) provided by Gusto, Inc. (“Gusto”); (b) add clients to the Gusto payroll platform (the “Platform”) between May 1, 2021 and August 31, 2021  (the “Promotion Period”); and (c) has completed or has at least one employee who has completed Gusto’s People Advisory Certification within six months of the end of the Promotion Period are eligible to participate in this promotion (the “Promotion”). By participating in this Promotion, you agree to be bound by these terms (the “Promotion Terms”) and the Gusto Terms. In the event of a conflict, the Promotion Terms will govern. Subject to these Promotion Terms, Partners will be eligible to receive a single check (the “Promotion Payout”)  in accordance with the Promotion Payout Table, included below. A “New Client” is a client that (i) has enrolled through the Partner’s “Add Client” screen or using the Partner’s unique referral link within Gusto’s Accountant Dashboard web page; (ii) has an Employer Identification Number that has not previously been used on the Platform; and (iii) has processed at least one payroll on the Gusto Platform during the Promotion Period.

Promotion Payout Table

Partners will be eligible for a Promotion Payout to the extent that they reach a Promotional Threshold during the Promotion Period.

Partner Ongoing Obligations

Promotion Payouts shall be sent via a single check payable to and delivered to the name and address provided by Partner within forty-five (45) days of the later of the following: (i) September 30, 2021, (ii) the requisite completion of Gusto’s People Advisory Certification, and (iii) the provision of a Form W-9 by Partner to Gusto.  If Partner is unable or unwilling to receive a Promotion Payout, Partner may request to receive an alternative promotion in the form of complimentary months of Gusto payroll services. If Partner or one of Partner’s employees fails to complete Gusto’s People Advisory Certification within six months of the end of the Promotion Period, Partner forfeits the Promotion Payout.

Partners must not participate in pay-per-click advertising on trademarked terms, including any derivations, variations or misspellings thereof, for search or content-based, campaigns on Google, MSN, or Yahoo. For the purposes of these terms, trademarked terms include Gusto, Gusto Payroll, Gusto HR, Gusto Benefits, Gusto Cashout, ZenPayroll, Gusto Coupon, and Buy Gusto (all keywords apply as a broad match). 

Gusto may terminate these Terms and/or the Promotion or modify the Terms and/or the Promotion for any reason and at any time, at Gusto’s sole discretion, without notice. Gusto reserves the right to declare an onboarding ineligible for the Promotion if Gusto determines that Partner is abusing the Promotion.
